2. BESCHRIJVING VAN DE DIENST
ShiftMate is een mobiele applicatie waarmee organisaties vrijwilligers kunnen inroosteren voor evenementen. De app biedt functionaliteit voor:
Het aanmaken en beheren van evenementen met rollen en shifts
Het uitnodigen van vrijwilligers voor een organisatie of evenement
Het inschrijven van vrijwilligers op shifts, met bewaking van dubbele inschrijvingen
Het versturen van herinneringen voorafgaand aan een shift
Het vastleggen van rolomschrijvingen en instructies per rol
3. ACCOUNTTYPEN EN TOEGANG
ShiftMate kent twee soorten gebruikers:
Beheerders/eigenaren: Zij maken een organisatie aan en beheren evenementen, rollen en vrijwilligers. Een abonnement is vereist voor onbeperkt gebruik (zie artikel 4).
Vrijwilligers: Zij worden uitgenodigd door een beheerder en gebruiken de app volledig gratis. Vrijwilligers kunnen geen eigen organisatie aanmaken zonder abonnement.
Je bent verantwoordelijk voor het geheimhouden van je inloggegevens en voor alle activiteiten die plaatsvinden via jouw account.
4. ABONNEMENT EN BETALINGEN
Voor beheerders die een organisatie aanmaken en beheren, biedt ShiftMate een betaald abonnement via RevenueCat en de App Store/Google Play. Het abonnement geeft onbeperkt toegang tot alle functies van de app, zonder beperkingen op het aantal vrijwilligers, evenementen, rollen of shifts.
Het abonnement wordt automatisch verlengd tenzij je het minimaal 24 uur voor het einde van de lopende periode opzegt
Opzegging verloopt via de instellingen van de App Store of Google Play op je apparaat
Terugbetaling van reeds betaalde termijnen is niet mogelijk, tenzij wettelijk verplicht
Prijswijzigingen worden minimaal 30 dagen van tevoren aangekondigd via de app
Betalingen worden verwerkt door Apple (App Store) of Google (Google Play). Wij hebben geen toegang tot je betaalgegevens.
5. AANVAARDBAAR GEBRUIK
Je mag ShiftMate uitsluitend gebruiken voor wettige doeleinden en in overeenstemming met deze voorwaarden. Het is niet toegestaan om:
De app te gebruiken voor activiteiten die in strijd zijn met de wet of de rechten van derden
Valse of misleidende informatie in te voeren in de app
Vrijwilligers te benaderen voor doeleinden buiten het gebruik van de app om
Te proberen de beveiliging of infrastructuur van de app te omzeilen of te verstoren
De app te reverse-engineeren, te kopiëren of af te leiden producten te maken
6. INTELLECTUEEL EIGENDOM
ShiftMate, inclusief de naam, het logo, de broncode en alle inhoud die door ons is gegenereerd, is eigendom van Peter Boekelaar en is beschermd door het auteursrecht en andere intellectuele eigendomsrechten. Je krijgt een beperkte, niet-exclusieve licentie om de app te gebruiken voor de doeleinden beschreven in deze voorwaarden. Je verwerft geen eigendomsrechten op de app of enig deel daarvan.
7. GEBRUIKERSINVOER EN GEGEVENS
Gegevens die jij of jouw organisatie invoert in ShiftMate — zoals namen van evenementen, rolomschrijvingen en persoonsgegevens van vrijwilligers — blijven jouw eigendom en verantwoordelijkheid. Als beheerder ben je verantwoordelijk voor het correct en rechtmatig verwerken van persoonsgegevens van vrijwilligers in overeenstemming met de AVG. Wij verwerken deze gegevens uitsluitend ten behoeve van de werking van de app, zoals beschreven in onze Privacyverklaring.
8. BESCHIKBAARHEID EN WIJZIGINGEN
Wij streven naar een zo hoog mogelijke beschikbaarheid van ShiftMate, maar kunnen dit niet garanderen. Wij behouden ons het recht voor om:
De app tijdelijk of permanent offline te halen voor onderhoud
Functies toe te voegen, te wijzigen of te verwijderen
Deze gebruiksvoorwaarden te wijzigen, met voorafgaande kennisgeving via de app
Voortgezet gebruik van de app na een wijziging van de voorwaarden geldt als acceptatie van de gewijzigde voorwaarden.
9. BEPERKING VAN AANSPRAKELIJKHEID
ShiftMate wordt aangeboden "zoals het is" en "zoals het beschikbaar is", zonder enige garantie van welke aard dan ook. Wij zijn niet aansprakelijk voor:
Directe of indirecte schade als gevolg van het gebruik of het niet kunnen gebruiken van de app
Verlies van gegevens door technische storingen
Schade als gevolg van ongeautoriseerde toegang tot jouw account door derden
Schade die voortvloeit uit het handelen of nalaten van vrijwilligers of beheerders
Voor zover wettelijk toegestaan is onze maximale aansprakelijkheid beperkt tot het bedrag dat jij in de drie maanden voorafgaand aan de schadeveroorzakende gebeurtenis aan ons hebt betaald.
10. BEËINDIGING
Jij kunt je account op elk moment verwijderen via de app. Wij kunnen je toegang opschorten of beëindigen als je deze voorwaarden schendt, zonder aansprakelijkheid voor schade als gevolg van die beëindiging. Bij beëindiging worden je persoonsgegevens verwijderd zoals beschreven in onze Privacyverklaring.
11. TOEPASSELIJK RECHT
Op deze gebruiksvoorwaarden is Nederlands recht van toepassing. Geschillen die voortvloeien uit of verband houden met het gebruik van ShiftMate worden voorgelegd aan de bevoegde rechter in het arrondissement Gelderland, Nederland.

1. ACCEPTANCE OF TERMS
By downloading, installing, or using ShiftMate Planner, you agree to these Terms of Use. If you do not agree to these terms, you may not use the app.
ShiftMate Planner is offered by Peter Boekelaar, based in Culemborg, the Netherlands (hereinafter: "we", "us", or "ShiftMate Planner").
2. DESCRIPTION OF THE SERVICE
ShiftMate Planner is a mobile application that allows organisations to schedule volunteers for events. The app provides functionality for:
Creating and managing events with roles and shifts
Inviting volunteers to an organisation or event
Registering volunteers for shifts, with protection against double bookings
Sending reminders prior to a shift
Recording role descriptions and instructions per role
3. ACCOUNT TYPES AND ACCESS
ShiftMate Planner has two types of users:
Administrators/owners: They create an organisation and manage events, roles, and volunteers. A subscription is required for unlimited use (see section 4).
Volunteers: They are invited by an administrator and use the app completely free of charge. Volunteers cannot create their own organisation without a subscription.
You are responsible for keeping your login credentials confidential and for all activities that take place through your account.
4. SUBSCRIPTION AND PAYMENTS
For administrators who create and manage an organisation, ShiftMate Planner offers a paid subscription via RevenueCat and the App Store/Google Play. The subscription provides unlimited access to all features of the app, with no restrictions on the number of volunteers, events, roles, or shifts.
The subscription automatically renews unless cancelled at least 24 hours before the end of the current period
Cancellation is handled through the settings of the App Store or Google Play on your device
Refunds for already paid periods are not possible, unless required by law
Price changes will be announced at least 30 days in advance via the app
Payments are processed by Apple (App Store) or Google (Google Play). We do not have access to your payment details.
5. ACCEPTABLE USE
You may only use ShiftMate Planner for lawful purposes and in accordance with these terms. It is not permitted to:
Use the app for activities that violate the law or the rights of third parties
Enter false or misleading information into the app
Approach volunteers for purposes outside the use of the app
Attempt to circumvent or disrupt the security or infrastructure of the app
Reverse-engineer, copy, or create derivative works from the app
6. INTELLECTUAL PROPERTY
ShiftMate Planner, including the name, logo, source code, and all content generated by us, is the property of Peter Boekelaar and is protected by copyright and other intellectual property rights. You are granted a limited, non-exclusive licence to use the app for the purposes described in these terms. You do not acquire any ownership rights in the app or any part of it.
7. USER INPUT AND DATA
Data that you or your organisation enter into ShiftMate Planner — such as event names, role descriptions, and personal data of volunteers — remain your property and responsibility. As an administrator, you are responsible for processing volunteers' personal data correctly and lawfully in accordance with the GDPR. We process this data solely for the purpose of operating the app, as described in our Privacy Policy.
8. AVAILABILITY AND CHANGES
We strive for the highest possible availability of ShiftMate Planner, but cannot guarantee this. We reserve the right to:
Take the app temporarily or permanently offline for maintenance
Add, modify, or remove features
Modify these Terms of Use, with prior notice via the app
Continued use of the app after a change to the terms constitutes acceptance of the revised terms.
9. LIMITATION OF LIABILITY
ShiftMate Planner is provided "as is" and "as available", without any warranty of any kind. We are not liable for:
Direct or indirect damages resulting from the use or inability to use the app
Loss of data due to technical failures
Damages resulting from unauthorised access to your account by third parties
Damages arising from the actions or omissions of volunteers or administrators
To the extent permitted by law, our maximum liability is limited to the amount you have paid to us in the three months preceding the event causing the damage.
10. TERMINATION
You can delete your account at any time via the app. We may suspend or terminate your access if you breach these terms, without liability for damages resulting from such termination. Upon termination, your personal data will be deleted as described in our Privacy Policy.
11. GOVERNING LAW
These Terms of Use are governed by Dutch law. Disputes arising from or related to the use of ShiftMate Planner shall be submitted to the competent court in the district of Gelderland, the Netherlands.

ShiftMate wird angeboten von Peter Boekelaar, ansässig in Culemborg, Niederlande (nachfolgend: „wir", „uns" oder „ShiftMate").
2. BESCHREIBUNG DES DIENSTES
ShiftMate ist eine mobile Anwendung, die es Organisationen ermöglicht, Freiwillige für Veranstaltungen einzuplanen. Die App bietet folgende Funktionen:
Erstellen und Verwalten von Veranstaltungen mit Rollen und Schichten
Einladen von Freiwilligen zu einer Organisation oder Veranstaltung
Anmeldung von Freiwilligen für Schichten mit Schutz vor Doppelbuchungen
Versenden von Erinnerungen vor einer Schicht
Erfassen von Rollenbeschreibungen und Anweisungen je Rolle
3. KONTOTYPEN UND ZUGANG
ShiftMate kennt zwei Benutzertypen:
Administratoren/Eigentümer: Sie erstellen eine Organisation und verwalten Veranstaltungen, Rollen und Freiwillige. Für die unbegrenzte Nutzung ist ein Abonnement erforderlich (siehe Abschnitt 4).
Freiwillige: Sie werden von einem Administrator eingeladen und nutzen die App vollständig kostenlos. Freiwillige können ohne Abonnement keine eigene Organisation erstellen.
Sie sind dafür verantwortlich, Ihre Anmeldedaten vertraulich zu behandeln und für alle Aktivitäten, die über Ihr Konto stattfinden.
4. ABONNEMENT UND ZAHLUNGEN
Für Administratoren, die eine Organisation erstellen und verwalten, bietet ShiftMate ein kostenpflichtiges Abonnement über RevenueCat und den App Store/Google Play. Das Abonnement gewährt unbegrenzten Zugang zu allen Funktionen der App, ohne Einschränkungen bei der Anzahl der Freiwilligen, Veranstaltungen, Rollen oder Schichten.
Das Abonnement verlängert sich automatisch, sofern es nicht mindestens 24 Stunden vor Ende des laufenden Zeitraums gekündigt wird
Die Kündigung erfolgt über die Einstellungen des App Store oder Google Play auf Ihrem Gerät
Eine Erstattung bereits bezahlter Zeiträume ist nicht möglich, sofern gesetzlich nicht anders vorgeschrieben
Preisänderungen werden mindestens 30 Tage im Voraus über die App angekündigt
Zahlungen werden von Apple (App Store) oder Google (Google Play) verarbeitet. Wir haben keinen Zugang zu Ihren Zahlungsdaten.
5. ZULÄSSIGE NUTZUNG
Sie dürfen ShiftMate ausschließlich für rechtmäßige Zwecke und in Übereinstimmung mit diesen Bedingungen verwenden. Es ist nicht gestattet:
Die App für Aktivitäten zu nutzen, die gegen das Gesetz oder die Rechte Dritter verstoßen
Falsche oder irreführende Informationen in die App einzugeben
Freiwillige für Zwecke außerhalb der App-Nutzung zu kontaktieren
Zu versuchen, die Sicherheit oder Infrastruktur der App zu umgehen oder zu stören
Die App zu reverse-engineeren, zu kopieren oder abgeleitete Werke zu erstellen
6. GEISTIGES EIGENTUM
ShiftMate, einschließlich des Namens, des Logos, des Quellcodes und aller von uns erstellten Inhalte, ist Eigentum von Peter Boekelaar und durch Urheberrecht und andere geistige Eigentumsrechte geschützt. Ihnen wird eine eingeschränkte, nicht-exklusive Lizenz zur Nutzung der App für die in diesen Bedingungen beschriebenen Zwecke eingeräumt. Sie erwerben keine Eigentumsrechte an der App oder Teilen davon.
7. BENUTZEREINGABEN UND DATEN
Daten, die Sie oder Ihre Organisation in ShiftMate eingeben — wie Veranstaltungsnamen, Rollenbeschreibungen und personenbezogene Daten von Freiwilligen — bleiben Ihr Eigentum und Ihre Verantwortung. Als Administrator sind Sie dafür verantwortlich, personenbezogene Daten von Freiwilligen korrekt und rechtmäßig gemäß der DSGVO zu verarbeiten. Wir verarbeiten diese Daten ausschließlich zum Betrieb der App, wie in unserer Datenschutzerklärung beschrieben.
8. VERFÜGBARKEIT UND ÄNDERUNGEN
Wir streben eine möglichst hohe Verfügbarkeit von ShiftMate an, können dies jedoch nicht garantieren. Wir behalten uns das Recht vor:
Die App vorübergehend oder dauerhaft für Wartungsarbeiten offline zu nehmen
Funktionen hinzuzufügen, zu ändern oder zu entfernen
Diese Nutzungsbedingungen zu ändern, mit vorheriger Benachrichtigung über die App
Die fortgesetzte Nutzung der App nach einer Änderung der Bedingungen gilt als Zustimmung zu den geänderten Bedingungen.
9. HAFTUNGSBESCHRÄNKUNG
ShiftMate wird „wie es ist" und „wie verfügbar" ohne jegliche Garantie zur Verfügung gestellt. Wir haften nicht für:
Direkte oder indirekte Schäden infolge der Nutzung oder Nichtnutzbarkeit der App
Datenverlust durch technische Störungen
Schäden infolge unbefugten Zugriffs auf Ihr Konto durch Dritte
Schäden, die aus dem Handeln oder Unterlassen von Freiwilligen oder Administratoren entstehen
Soweit gesetzlich zulässig, ist unsere maximale Haftung auf den Betrag beschränkt, den Sie in den drei Monaten vor dem schadenverursachenden Ereignis an uns gezahlt haben.
10. KÜNDIGUNG
Sie können Ihr Konto jederzeit über die App löschen. Wir können Ihren Zugang sperren oder beenden, wenn Sie gegen diese Bedingungen verstoßen, ohne Haftung für Schäden, die aus einer solchen Beendigung entstehen. Bei Beendigung werden Ihre personenbezogenen Daten wie in unserer Datenschutzerklärung beschrieben gelöscht.
11. ANWENDBARES RECHT
Für diese Nutzungsbedingungen gilt niederländisches Recht. Streitigkeiten, die sich aus der Nutzung von ShiftMate ergeben oder damit zusammenhängen, werden dem zuständigen Gericht im Bezirk Gelderland, Niederlande, vorgelegt.

En téléchargeant, installant ou utilisant ShiftMate Planner, vous acceptez les présentes conditions d'utilisation. Si vous n'acceptez pas ces conditions, vous n'êtes pas autorisé à utiliser l'application.
ShiftMate Planner est proposé par Peter Boekelaar, établi à Culemborg, Pays-Bas (ci-après : « nous » ou « ShiftMate Planner »).
2. DESCRIPTION DU SERVICE
ShiftMate Planner est une application mobile permettant aux organisations de planifier des bénévoles pour des événements. L'application offre les fonctionnalités suivantes :
Création et gestion d'événements avec des rôles et des créneaux
Invitation de bénévoles au sein d'une organisation ou pour un événement
Inscription de bénévoles à des créneaux, avec protection contre les doubles réservations
Envoi de rappels avant un créneau
Enregistrement des descriptions de rôles et des instructions par rôle
3. TYPES DE COMPTES ET ACCÈS
ShiftMate Planner dispose de deux types d'utilisateurs :
Administrateurs/propriétaires : Ils créent une organisation et gèrent les événements, les rôles et les bénévoles. Un abonnement est requis pour une utilisation illimitée (voir article 4).
Bénévoles : Ils sont invités par un administrateur et utilisent l'application entièrement gratuitement. Les bénévoles ne peuvent pas créer leur propre organisation sans abonnement.
Vous êtes responsable de la confidentialité de vos identifiants de connexion et de toutes les activités qui se déroulent via votre compte.
4. ABONNEMENT ET PAIEMENTS
Pour les administrateurs qui créent et gèrent une organisation, ShiftMate Planner propose un abonnement payant via RevenueCat et l'App Store/Google Play. L'abonnement offre un accès illimité à toutes les fonctionnalités de l'application, sans restriction sur le nombre de bénévoles, d'événements, de rôles ou de créneaux.
L'abonnement se renouvelle automatiquement sauf résiliation au moins 24 heures avant la fin de la période en cours
La résiliation s'effectue via les paramètres de l'App Store ou de Google Play sur votre appareil
Le remboursement des périodes déjà payées n'est pas possible, sauf obligation légale contraire
Les modifications de prix seront annoncées au moins 30 jours à l'avance via l'application
Les paiements sont traités par Apple (App Store) ou Google (Google Play). Nous n'avons pas accès à vos données de paiement.
5. UTILISATION ACCEPTABLE
Vous ne pouvez utiliser ShiftMate Planner qu'à des fins légales et conformément aux présentes conditions. Il est interdit de :
Utiliser l'application à des fins contraires à la loi ou aux droits de tiers
Saisir des informations fausses ou trompeuses dans l'application
Contacter des bénévoles à des fins étrangères à l'utilisation de l'application
Tenter de contourner ou de perturber la sécurité ou l'infrastructure de l'application
Procéder à une ingénierie inverse, copier ou créer des œuvres dérivées de l'application
6. PROPRIÉTÉ INTELLECTUELLE
ShiftMate Planner, y compris le nom, le logo, le code source et tout le contenu généré par nos soins, est la propriété de Peter Boekelaar et est protégé par le droit d'auteur et d'autres droits de propriété intellectuelle. Vous bénéficiez d'une licence limitée et non exclusive pour utiliser l'application aux fins décrites dans les présentes conditions. Vous n'acquérez aucun droit de propriété sur l'application ou une partie de celle-ci.
7. DONNÉES ET SAISIES UTILISATEUR
Les données que vous ou votre organisation saisissez dans ShiftMate Planner — telles que les noms d'événements, les descriptions de rôles et les données personnelles des bénévoles — restent votre propriété et votre responsabilité. En tant qu'administrateur, vous êtes responsable du traitement correct et licite des données personnelles des bénévoles conformément au RGPD. Nous traitons ces données uniquement aux fins du fonctionnement de l'application, comme décrit dans notre Politique de confidentialité.
8. DISPONIBILITÉ ET MODIFICATIONS
Nous nous efforçons d'assurer la plus haute disponibilité possible de ShiftMate Planner, mais ne pouvons le garantir. Nous nous réservons le droit de :
Mettre l'application hors ligne temporairement ou définitivement pour maintenance
Ajouter, modifier ou supprimer des fonctionnalités
Modifier les présentes conditions d'utilisation, avec notification préalable via l'application
La poursuite de l'utilisation de l'application après une modification des conditions vaut acceptation des conditions révisées.
9. LIMITATION DE RESPONSABILITÉ
ShiftMate Planner est fourni « tel quel » et « selon disponibilité », sans aucune garantie d'aucune sorte. Nous ne sommes pas responsables :
Des dommages directs ou indirects résultant de l'utilisation ou de l'impossibilité d'utiliser l'application
De la perte de données due à des défaillances techniques
Des dommages résultant d'un accès non autorisé à votre compte par des tiers
Des dommages découlant des actions ou omissions de bénévoles ou d'administrateurs
Dans la mesure permise par la loi, notre responsabilité maximale est limitée au montant que vous nous avez payé au cours des trois mois précédant l'événement à l'origine du dommage.
10. RÉSILIATION
Vous pouvez supprimer votre compte à tout moment via l'application. Nous pouvons suspendre ou résilier votre accès en cas de violation des présentes conditions, sans responsabilité pour les dommages résultant de cette résiliation. En cas de résiliation, vos données personnelles seront supprimées comme décrit dans notre Politique de confidentialité.
11. DROIT APPLICABLE
Les présentes conditions d'utilisation sont régies par le droit néerlandais. Les litiges découlant de ou liés à l'utilisation de ShiftMate Planner seront soumis au tribunal compétent de l'arrondissement de Gueldre, Pays-Bas.

3. TIPOS DE CUENTA Y ACCESO
ShiftMate tiene dos tipos de usuarios:
Administradores/propietarios: Crean la organización y gestionan eventos, roles y voluntarios. Se requiere suscripción para uso ilimitado (ver sección 4).
Voluntarios: Invitados por un administrador, usan la app completamente gratis. Los voluntarios no pueden crear su propia organización sin suscripción.
Eres responsable de mantener confidenciales tus credenciales y de todas las actividades que tengan lugar a través de tu cuenta.
4. SUSCRIPCIÓN Y PAGOS
Para administradores que crean y gestionan una organización, ShiftMate ofrece una suscripción de pago a través de RevenueCat y App Store/Google Play. La suscripción proporciona acceso ilimitado a todas las funciones de la app, sin restricciones en el número de voluntarios, eventos, roles o turnos.
La suscripción se renueva automáticamente salvo cancelación al menos 24 horas antes del final del período en curso
La cancelación se gestiona en los ajustes del App Store o Google Play en tu dispositivo
No se realizan reembolsos de períodos ya pagados, salvo obligación legal
Los cambios de precio se anunciarán con al menos 30 días de antelación a través de la app
Los pagos son procesados por Apple (App Store) o Google (Google Play). No tenemos acceso a tus datos de pago.
5. USO ACEPTABLE
Solo puedes usar ShiftMate para fines legales y de conformidad con estas condiciones. Está prohibido:
Usar la app para actividades ilegales o que vulneren derechos de terceros
Introducir información falsa o engañosa en la app

6. PROPIEDAD INTELECTUAL
ShiftMate, incluyendo el nombre, el logo, el código fuente y el contenido generado por nosotros, es propiedad de Peter Boekelaar y está protegido por derechos de autor y otros derechos de propiedad intelectual. Se te otorga una licencia limitada y no exclusiva para usar la app con los fines descritos en estas condiciones. No adquieres ningún derecho de propiedad sobre la app ni sobre parte alguna de ella.
7. DATOS E INFORMACIÓN DEL USUARIO
Los datos que tú o tu organización introduzcáis en ShiftMate — como nombres de eventos, descripciones de roles y datos personales de voluntarios — son de tu propiedad y responsabilidad. Como administrador, eres responsable del tratamiento correcto y legal de los datos personales de los voluntarios conforme al RGPD. Procesamos esos datos únicamente para el funcionamiento de la app, tal como se describe en nuestra Política de privacidad.
8. DISPONIBILIDAD Y CAMBIOS
Nos esforzamos por la máxima disponibilidad de ShiftMate, pero no podemos garantizarla. Nos reservamos el derecho de:
Poner la app fuera de línea temporal o permanentemente para mantenimiento
Añadir, modificar o eliminar funciones
Modificar estas condiciones de uso, con aviso previo a través de la app
El uso continuado de la app tras una modificación de las condiciones implica la aceptación de las condiciones revisadas.
9. LIMITACIÓN DE RESPONSABILIDAD
ShiftMate se ofrece "tal cual" y "según disponibilidad", sin garantía de ningún tipo. No somos responsables de:
Daños directos o indirectos derivados del uso o la imposibilidad de usar la app
Pérdida de datos por fallos técnicos
Daños derivados de acceso no autorizado a tu cuenta por terceros
Daños derivados de acciones u omisiones de voluntarios o administradores
En la medida permitida por la ley, la responsabilidad máxima se limita al importe pagado en los tres meses anteriores al evento causante del daño.
10. RESOLUCIÓN
Puedes eliminar tu cuenta en cualquier momento desde la app. Podemos suspender o cancelar tu acceso si incumples estas condiciones, sin responsabilidad por daños derivados de dicha resolución. Los datos se eliminan según nuestra Política de privacidad.
11. LEY APLICABLE
Estas condiciones se rigen por el derecho neerlandés. Los litigios derivados o relacionados con el uso de ShiftMate se someterán al tribunal competente del distrito de Güeldres, Países Bajos.

1. ACCETTAZIONE DELLE CONDIZIONI
Scaricando, installando o utilizzando ShiftMate, accetti queste Condizioni d'uso. Se non sei d'accordo, non puoi usare l'app.
ShiftMate è offerto da Peter Boekelaar, con sede a Culemborg, Paesi Bassi.
2. DESCRIZIONE DEL SERVIZIO
ShiftMate è un'applicazione mobile che consente alle organizzazioni di pianificare i volontari per gli eventi. L'app offre le seguenti funzionalità:
Creare e gestire eventi con ruoli e turni
Invitare volontari a un'organizzazione o a un evento
Iscrivere volontari ai turni con protezione contro le doppie prenotazioni
Inviare promemoria prima di un turno
Registrare descrizioni e istruzioni per ruolo
3. TIPI DI ACCOUNT E ACCESSO
ShiftMate prevede due tipi di utenti:
Amministratori/proprietari: Creano l'organizzazione e gestiscono eventi, ruoli e volontari. È richiesto un abbonamento per uso illimitato (vedere sezione 4).
Volontari: Invitati da un amministratore, usano l'app completamente gratis. I volontari non possono creare una propria organizzazione senza abbonamento.
Sei responsabile della riservatezza delle tue credenziali e di tutte le attività che hanno luogo tramite il tuo account.
4. ABBONAMENTO E PAGAMENTI
Per gli amministratori che creano e gestiscono un'organizzazione, ShiftMate offre un abbonamento a pagamento tramite RevenueCat e App Store/Google Play. L'abbonamento fornisce accesso illimitato a tutte le funzionalità dell'app, senza restrizioni sul numero di volontari, eventi, ruoli o turni.
L'abbonamento si rinnova automaticamente salvo disdetta almeno 24 ore prima della fine del periodo in corso
La disdetta viene gestita nelle impostazioni dell'App Store o Google Play sul tuo dispositivo
Non sono previsti rimborsi per i periodi già pagati, salvo obbligo di legge
Le modifiche di prezzo saranno comunicate con almeno 30 giorni di anticipo tramite l'app
I pagamenti vengono elaborati da Apple (App Store) o Google (Google Play). Non abbiamo accesso ai tuoi dati di pagamento.
5. USO ACCETTABILE
Puoi utilizzare ShiftMate solo per scopi legali e in conformità con queste condizioni. È vietato:
Usare l'app per attività illegali o che violino i diritti di terzi
Inserire informazioni false o fuorvianti nell'app
Contattare i volontari al di fuori dell'app
Tentare di eludere o disturbare la sicurezza o l'infrastruttura dell'app
Effettuare reverse engineering, copiare o creare opere derivate dall'app
6. PROPRIETÀ INTELLETTUALE
ShiftMate, inclusi nome, logo, codice sorgente e contenuti da noi generati, è di proprietà di Peter Boekelaar ed è protetto dal diritto d'autore e da altri diritti di proprietà intellettuale. Ti viene concessa una licenza limitata e non esclusiva per utilizzare l'app per gli scopi descritti in queste condizioni. Non acquisisci alcun diritto di proprietà sull'app o su parte di essa.
7. DATI E INPUT DEGLI UTENTI
I dati inseriti da te o dalla tua organizzazione in ShiftMate — come nomi di eventi, descrizioni di ruoli e dati personali dei volontari — restano di tua proprietà e responsabilità. Come amministratore, sei responsabile del trattamento corretto e lecito dei dati personali dei volontari ai sensi del GDPR. Elaboriamo tali dati esclusivamente per il funzionamento dell'app, come descritto nella nostra Informativa sulla privacy.
8. DISPONIBILITÀ E MODIFICHE
Ci impegniamo per la massima disponibilità di ShiftMate, ma non possiamo garantirla. Ci riserviamo il diritto di:
Mettere l'app offline temporaneamente o permanentemente per manutenzione
Aggiungere, modificare o rimuovere funzionalità
Modificare queste condizioni d'uso, con preavviso tramite l'app
Il continuo utilizzo dell'app dopo una modifica delle condizioni costituisce accettazione delle condizioni aggiornate.
9. LIMITAZIONE DI RESPONSABILITÀ
ShiftMate viene fornito "così com'è" e "come disponibile", senza alcuna garanzia di alcun tipo. Non siamo responsabili di:
Danni diretti o indiretti derivanti dall'uso o dall'impossibilità di utilizzare l'app
Perdita di dati a causa di guasti tecnici
Danni derivanti da accesso non autorizzato al tuo account da parte di terzi
Danni derivanti da azioni o omissioni di volontari o amministratori
Nella misura consentita dalla legge, la responsabilità massima è limitata all'importo pagato nei tre mesi precedenti l'evento che ha causato il danno.
10. RISOLUZIONE
Puoi eliminare il tuo account in qualsiasi momento dall'app. Possiamo sospendere o terminare il tuo accesso in caso di violazione di queste condizioni, senza responsabilità per danni derivanti da tale risoluzione. I dati vengono eliminati come descritto nella nostra Informativa sulla privacy.
11. LEGGE APPLICABILE
Queste condizioni sono regolate dal diritto olandese. Le controversie derivanti da o legate all'utilizzo di ShiftMate saranno sottoposte al tribunale competente del distretto di Gheldria, Paesi Bassi.
Ao descarregar, instalar ou utilizar o ShiftMate, aceita estes Termos de utilização. Se não concordar, não pode utilizar a aplicação.
O ShiftMate é oferecido por Peter Boekelaar, sediado em Culemborg, Países Baixos.
2. DESCRIÇÃO DO SERVIÇO
O ShiftMate é uma aplicação móvel que permite às organizações planear voluntários para eventos. A aplicação oferece as seguintes funcionalidades:
Criar e gerir eventos com funções e turnos
Convidar voluntários para uma organização ou evento
Inscrever voluntários em turnos com proteção contra duplicações
Enviar lembretes antes de um turno
Registar descrições e instruções por função
3. TIPOS DE CONTA E ACESSO
O ShiftMate tem dois tipos de utilizadores:
Administradores/proprietários: Criam a organização e gerem eventos, funções e voluntários. É necessária uma subscrição para utilização ilimitada (ver secção 4).
Voluntários: Convidados por um administrador, utilizam a aplicação completamente grátis. Os voluntários não podem criar a sua própria organização sem subscrição.
É responsável pela confidencialidade das suas credenciais e por todas as atividades que ocorram através da sua conta.
4. SUBSCRIÇÃO E PAGAMENTOS
Para administradores que criam e gerem uma organização, o ShiftMate oferece uma subscrição paga através do RevenueCat e App Store/Google Play. A subscrição fornece acesso ilimitado a todas as funcionalidades da app, sem restrições no número de voluntários, eventos, funções ou turnos.
A subscrição renova-se automaticamente salvo cancelamento pelo menos 24 horas antes do fim do período em curso
O cancelamento é efetuado nas definições da App Store ou Google Play no seu dispositivo
Não são efetuados reembolsos de períodos já pagos, salvo obrigação legal
As alterações de preço serão comunicadas com pelo menos 30 dias de antecedência através da aplicação
Os pagamentos são processados pela Apple (App Store) ou Google (Google Play). Não temos acesso aos seus dados de pagamento.
5. UTILIZAÇÃO ACEITÁVEL
Só pode utilizar o ShiftMate para fins legais e em conformidade com estes termos. É proibido:
Usar a aplicação para atividades ilegais ou que violem direitos de terceiros
Introduzir informações falsas ou enganosas na aplicação
Contactar voluntários fora do âmbito da app
Tentar contornar ou perturbar a segurança ou infraestrutura da aplicação
Efetuar engenharia inversa, copiar ou criar obras derivadas da aplicação
6. PROPRIEDADE INTELECTUAL
O ShiftMate, incluindo o nome, logótipo, código-fonte e conteúdo gerado por nós, é propriedade de Peter Boekelaar e está protegido por direitos de autor e outros direitos de propriedade intelectual. É-lhe concedida uma licença limitada e não exclusiva para utilizar a aplicação para os fins descritos nestes termos. Não adquire quaisquer direitos de propriedade sobre a aplicação ou qualquer parte da mesma.
7. DADOS E ENTRADAS DO UTILIZADOR
Os dados introduzidos por si ou pela sua organização no ShiftMate — como nomes de eventos, descrições de funções e dados pessoais de voluntários — são da sua propriedade e responsabilidade. Como administrador, é responsável pelo tratamento correto e legal dos dados pessoais dos voluntários ao abrigo do RGPD. Processamos esses dados exclusivamente para o funcionamento da aplicação, conforme descrito na nossa Política de privacidade.
8. DISPONIBILIDADE E ALTERAÇÕES
Esforçamo-nos pela máxima disponibilidade do ShiftMate, mas não podemos garantir. Reservamo-nos o direito de:
Colocar a aplicação offline temporária ou permanentemente para manutenção
Adicionar, modificar ou remover funcionalidades
Alterar estes termos de utilização, com aviso prévio através da aplicação
A utilização continuada da aplicação após uma alteração dos termos constitui aceitação dos termos revistos.
9. LIMITAÇÃO DE RESPONSABILIDADE
O ShiftMate é fornecido "tal como está" e "conforme disponível", sem qualquer garantia de qualquer tipo. Não somos responsáveis por:
Danos diretos ou indiretos resultantes da utilização ou impossibilidade de utilização da aplicação
Perda de dados devido a falhas técnicas
Danos resultantes de acesso não autorizado à sua conta por terceiros
Danos decorrentes de ações ou omissões de voluntários ou administradores
Na medida permitida por lei, a responsabilidade máxima limita-se ao montante pago nos três meses anteriores ao evento causador do dano.
10. RESCISÃO
Pode eliminar a sua conta a qualquer momento a partir da aplicação. Podemos suspender ou terminar o seu acesso em caso de incumprimento destes termos, sem responsabilidade por danos resultantes dessa rescisão. Os dados são eliminados conforme descrito na nossa Política de privacidade.
11. LEI APLICÁVEL
Estes termos são regidos pelo direito neerlandês. Os litígios decorrentes de ou relacionados com a utilização do ShiftMate serão submetidos ao tribunal competente do distrito de Guéldria, Países Baixos.
